Acceptance of Terms

By accessing or using the website at tracysunroomsnpatios.com, by requesting an estimate, or by entering into any service agreement with NextGen Tracy Sunrooms & Patios ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this website or engage our services.

These terms apply to all visitors to our website and to all customers who retain our services. We may update these terms from time to time. Continued use of the website or continued engagement of our services after any update constitutes your acceptance of the revised terms.

Description of Services

NextGen Tracy Sunrooms & Patios is a licensed sunroom contractor providing sunroom additions, patio enclosures, four season and three season sunrooms, patio-to-sunroom conversions, deck-to-sunroom conversions, screen room installation, solarium installation, patio cover installation, and related construction and remodeling services. Services are provided to residential property owners in Tracy, CA and the surrounding service area.

All services are subject to a written scope of work and contract executed betweenNextGen Tracy Sunrooms & Patios and the customer prior to the commencement of any work. Nothing on this website constitutes an offer to perform services or a binding contract.

Estimates and Pricing

Estimates provided by NextGen Tracy Sunrooms & Patios are based on information available at the time of the site visit and are good-faith approximations of project cost. An estimate is not a binding contract and does not obligate either party until a written contract is signed by both the customer and an authorized representative of NextGen Tracy Sunrooms & Patios.

Project costs may change if the scope of work changes, if site conditions are discovered during construction that differ materially from what was observed at the time of the estimate, or if material prices change between the estimate date and the project start date. Any changes to the agreed scope of work and pricing will be documented in a written change order signed by both parties before additional work proceeds.

Scheduling and Cancellation

Project start dates are subject to permit timelines, material availability, and crew scheduling. We will provide you with an estimated start date and keep you updated if that date changes. We are not liable for delays caused by local permitting authorities, weather, material supply issues, or circumstances beyond our reasonable control.

If you need to cancel or postpone a scheduled project, please notify us in writing as soon as possible. Cancellation terms, including any deposit refund policies, will be specified in your written service contract. In general, deposits covering work already completed or materials already ordered are non-refundable.

Payment Terms

Payment schedules and terms will be set forth in the written service contract. In general, a deposit is due upon contract signing, progress payments may be due at defined project milestones, and the final balance is due upon project completion and customer walkthrough.

Payments not received within the timeframe specified in the contract may be subject to late fees as described in the contract. We reserve the right to suspend work on any project where payment is materially past due. All prices are in U.S. dollars.

Permits and Compliance

NextGen Tracy Sunrooms & Patios will apply for and manage all required building permits for work we perform, unless otherwise agreed in writing. The customer is responsible for obtaining any required approvals from their homeowners association (HOA) before work begins, unless we have expressly agreed to manage that process on your behalf. Delays caused by HOA review timelines are outside our control and do not constitute a breach of our service agreement.

Warranty Disclaimers

We stand behind our work. Any workmanship warranty applicable to your specific project will be described in your written service contract. Manufacturer warranties on materials, windows, and other components are passed through to you as the customer and are subject to the terms of the respective manufacturer.

If mediation does not resolve the dispute, any legal action shall be brought in the state or federal courts located in San Joaquin County, California, and both parties consent to the personal jurisdiction of those courts.

Governing Law

These Terms and Conditions and any disputes arising out of or related to them or our services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms and Conditions from time to time. When we do, we will update the effective date at the top of this page. We encourage you to review these terms periodically.
